long...sorry

okay LONG story trying to be short!

My dog Lola had a seizure one day and 5 days or so she had another one. They became very sparse. We took her(10/10/13 to one vet the minute we asked a payment arrangments. He quickly wrote a Rx and sent us on way.my hubby brought Lola home and started to look for a different vet. By this time is was wee hour to find a vet to take our case. We took Lola with every intent of having her layed to rest. We had all decided we did not want her to suffer. the first vet we went to have her put down. When we went into the private room just normal as usual. The vet came inside the room and looked at lola. The 5 minutes he was with us. She said would not put her down she would send her to a rescue or keep her. The rather the put her down. She again was given an Rx to giver her. We came home and gave the meds like we were told to do. that evening we only gave her a half tablet being so late in the afternoon ( She continued to have a couple seizures off and on, the vet stated it would take sometime.thils was on (10/10/13) The very next day 10/11/13 we again gave her the meds she told us to get her. She moped all day. She was extemely lathargic. She was barely moing across the floor, bumping in to everything; like she was trying to hide her face from us.We (all 3 of us) stayed and layed with her just rubbing her and trying to comfort her as best we could. You could tell she was in extreme pain whining and moaning and crying she finally closed her eyes and fell asleep she was still breathing. Not even 5 minutes had passed since we left the room my 14y/0 went back to the kitchen as he came back though the living room and just one more check...He found her not breathing. (10/12/13 around 4:30am) Do I have a case against the vet who refused to put her to rest as we wanted so she would not suffer, and basically leaving her to suffer and a long/slow/ death.

you can TRY...but honestly, I doubt anything will be done. The vet has to do a medical examination to determine weather or not the dog should/should not be put down. They usually won't put down a pet because an owner wants them to. However, telling you that they will not put the dog down, and send it to a rescue instead, without an examination, is not exactly regular practice.

If you needed payment plans, they probably figured that you can't afford a full medical exam, and therefore figured the dog would be better off in a shelter. They called a shot based on an assumption.

Yes, you can...for "gross negligence". But pets in this manner are considered property and the only thing you get will be the value of the dog...If you had a high value dog, it may be worth it...but think of the lawyer fees on top of it. If you had a "mutt" it wouldn't be worth the hassle....Also usually it only works if the vet actually caused the death of an animal. Not sure exactly how it would work in your case. With 2 different vets giving you meds instead of putting the dog down you may find it hard to say they were wrong about what they did.
