JessiKa yells roll tide --- 13 years ago -

My ex husband and I have been divorced since December. He has since deployed and im wanting to re-open the case. He is saying I cant "serve" him papers downrange. I guess I would be "serving" him papers, then again, we are already divorced, I just want some things changed. Would anyones husband know anything about this?

He is protected under the soldiers sailors act. You cannot take him to court for anything while he is deployed, even if he is home on r&r. You will have to wait until he gets home from the deployment.

Ok I was just corrected by my husband, you can go ahead and file but he then can claim SSRA, and everything will be put on hold till he gets back. If he is on board with the changes then you can send it certified mail and when he signs for it the courts considered him served

You can have them served overseas but it will cost you a ton of money, and if you happen to wind up in a courtroom it can look bad depending on the judge. At least that's what a lawyer in NC told me when I first looked into divorce when I lived there.
